Welcome to Lively Acres Campground. By using our website at https://livelyacrescampground.com, placing an order, or creating an account, you agree to the following terms and conditions.

1. Booking and Payment

  • All reservations are subject to availability and must be paid in full at the time of booking.
  • We use Stripe to securely process all payments. We do not store or have access to your full credit card number.
  • Prices and availability are subject to change without notice; however, we will honor any pricing agreed to at the time of your confirmed booking.

2. Account Creation and Saved Payment Methods

  • Automatic Account Creation: When you complete a booking, a user account is automatically created for your convenience using your email address. You will receive an email with a link to set your password and access your account to view order history, review bookings, and update your information.
  • Saved Payment Information: By providing your payment card information during checkout, you authorize Lively Acres Campground to securely store your payment method with Stripe for future charges related to your stay.
  • Future Charges: Your saved payment method may be charged for:
    • Additional campground services or bookings requested during your stay
    • Damage fees, missing equipment, or policy violations as outlined in our Campground Information and Fee Schedule
    • Any other charges you explicitly authorize
  • Pre-Authorization Notice: We will notify you in person, by phone, or by email before processing any additional charges to your saved payment method. You will have the opportunity to discuss the charges and provide alternative payment if preferred.
  • Damage Assessment: In the event of damage to campground property or equipment, we will document the damage with photos when possible, provide you with an itemized explanation of charges based on our published fee schedule, and obtain your acknowledgment before charging your saved payment method.
  • Removing Saved Payment Methods: You may remove saved payment methods from your account at any time by logging in or contacting us directly. However, a valid payment method on file may be required to maintain active or future reservations.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • We reserve the right to suspend or delete accounts that violate these terms or misuse our website.

4. Payment Disputes

  • If you believe a charge to your saved payment method was made in error, please contact us immediately at [email protected] or (231) 994-9339.
  • We will work with you in good faith to resolve any billing disputes within 30 days of the charge.
  • You retain all rights to dispute charges with your card issuer in accordance with your cardholder agreement.

5. Email Communications

  • By creating an account, you will receive transactional emails related to your booking, account creation, and any charges to your saved payment method.
  • You may choose to opt in to receive promotional emails. You can unsubscribe from promotional emails at any time.
  • Transactional emails (booking confirmations, charge notifications, account information) cannot be unsubscribed from because they are necessary for your account to operate.

6. Website Content

  • All content on this site, including images, text, graphics, and logos, is the property of Lively Acres Campground or its content suppliers and may not be reused without permission.
  • We may include links to third-party websites. We are not responsible for the content or privacy policies of those websites.

7. User Conduct

By using this site, you agree not to:

  • Use the site for any unlawful purpose or in violation of any applicable laws
  • Interfere with or disrupt the operation of the website
  • Attempt to gain unauthorized access to our systems or other user accounts
  • Post or transmit any harmful, offensive, or inappropriate material
  • Dispute legitimate charges in bad faith or engage in chargeback fraud

8. Privacy and Data Security

  • Your payment information is processed and stored securely by Stripe in accordance with PCI-DSS standards.
  • We collect and use your personal information as described in our Privacy Policy.
  • We will never sell or share your payment information with third parties except as necessary to process transactions and comply with legal requirements.

9. Limitation of Liability

To the fullest extent permitted by law, Lively Acres Campground shall not be liable for any damages, losses, or injuries resulting from:

  • Use of this website
  • Booking cancellations
  • Site errors or downtime
  • Actions of third-party service providers (including payment processors)
  • Unauthorized access to your account due to your failure to protect your login credentials

10. Indemnification

You agree to indemnify and hold harmless Lively Acres Campground and its owners, staff, and affiliates from any claims, liabilities, damages, or expenses arising from your use of the site, violation of these terms, or damages caused to campground property during your stay.

11. Governing Law

These Terms are governed by the laws of the State of Michigan, United States. Any disputes will be resolved in the appropriate courts located in Michigan.

12. Severability

We may update these Terms and Conditions at any time. Changes will be effective immediately upon posting to this page. Your continued use of the website after changes are posted constitutes acceptance of the modified terms.
